Parents bringing governments to court over clawback


The National Child Benefit Supplement was introduced in 1997 to prevent and reduce child poverty, giving families with annual incomes under $22,615 approximately $115 per child per month.

However, the 1997 agreement between the federal, provincial and territorial governments required that the amount of the NCBS be deducted from the families on social assistance, cutting the most vulnerable families off from this crucial program.
In spite of the agreement, Manitoba and New Brunswick do not claw back the NCBS, while the others claw back some or all of the benefit.

The Ontario government claws back the NCBS from both Ontario Works and Ontario Disability Support Program recipients.

The monies that are clawed back from the families are supposed to be reinvested in new programs for low-income families.

One of the groups representing social assistance recipients in the legal challenge is the Income Security Advocacy Centre.
